If I recall this thread from a few days ago, I think the answer
is "yes" (to both questions).

You can't have side effects, so you can't set global variables
From inside a construction rule.  However, you can use
(inherited-attribute-string) or even a function to test the
value of the attribute on the top-most element wherever you need
to in processing.
