The change from allowing <license> both inside and outside <permissions> to
requiring it to be inside <permissions> was made so that all information
relating to usage would be grouped.

The change was not enforced in version 2.3 because it was a
backward-incompatible change, and point releases (2.1, 2.2, 2.3) were fully
backwards-compatible. However, as you note, the 2.3 Tag Library did advise
users to put <license> inside <permissions>.

NLM version 3.0 (which was the source for JATS 1.0) tidied up a lot of things
that the working group considered imperfect but that could not be changed
without making backwards-incompatible changes. Allowing <license> only inside
<permissions> was one of those changes. A list of all of the changes made at
