Looks like I have no choice in this instance. well according to the document recently posted by w3c the current plan for xslt 1.1 is to make the coersion to node set no longer needed (ie the previous MS behaviour will be legalised) Otherwise you can use document('') instead of a variable to access the nodes in a portable way.
