so the test is

no non white space text nodes
all odd element nodes are a (and there are at least three of these
all even element nodes are br

?

not(text() != '') and
not(*[(position() mod 2 = 1) and not(self::a)]) and
(count(a) &gt; 2) and
not(*[(position() mod 2 = 0) and not(self::br)])
]
