It looks fine to me, and works with msxml3, msxml4, saxon6.5.2 and xalan2.4.1

Are you sure you have applied-templates in its parent (or wherever) so that it gets processed?  It could well be that you are using something like <xsl:apply-templates select="*"/> which doesnt include pi's...
