In general UPA violations are easily solved if you rewrite the ambiguous model in a non ambiguous way. In your case
<!ELEMENT item (risid,(waiting|passing|(waiting,passing)))>
can be written as
<!ELEMENT item (risid,((waiting, passing?)|passing))>
