Still thinking about this:

I should really have suggested simply "not($cont = translate($cont,$alpha,''))" ... except it doesn't work when $cont is empty. But then neither do the others we've suggested ... so try

$cont and not($cont = translate($cont,$alpha,''))

Sorry for thinking aloud (and thanks Andrew for banging on it).
