I think it's an area where 1.0 processors are known to differ. Some adopt a rigid interpretation in which <xsl:choose xml:space="preserve"> <xsl:when> ... is treated as an error on the grounds that text content is not allowed inside xsl:choose; while other processors adopt a more user-friendly interpretation (but one that isn't necessarily justified by the spec).
