as both "Municipal Act" and "Fish Protection Act" are not exactly the same as the text() in the <em> node.. contains won't work either because you have sequences of more than one item.

Only if the EM elements correspond strictly to tokens. For example this would not work (or would, depending on the exact requirements):
... ; bla <em>bla</em> bla ; ...
It depends if the OP wants to match on "bla" or " bla bla bla ".
