... so since you are checking a structure, my second suggestion won't 
work either because the right-hand side cannot be a structure.  I 
guess that is why it was my habit to use string(.) on the left hand side.

Now, "instance of" takes a sequence type:

  http://www.w3.org/TR/2007/REC-xpath20-20070123/#id-instance-of

... but as you say, there are no type annotations on your input, so I 
don't think ". instance of element(Book, BookType)" will work for you.

I think you may be stuck.
