Ignore previous reply. I can confirm that this is a bug that was present in Saxon 9.6.0.3 thru 9.6.0.8, and not present in 9.6.0.9 or in any 9.5 or 9.7 release. Having said that, I haven't identified with certainty what bug it actually is. My suspicion is that it was fixed in the course of fixing https://saxonica.plan.io/issues/2577 even though that bug doesn't describe the current symptoms, the logic error in the code might well have had other symptoms that we didn't know about at the time.
