Eric Bacher made it.  His homebrew 2600 company is called "Ebivision"
(www.ebivision.com, I think).  The game is available via Best Electronics.

It was released at World of Atari 98*, which eventually became the CGExpo.

I don't know much about his "Escape from Supercade" project, tho.  Anyone
know anything about it?

I thought he used the difficulty switches to toggle different modes.  You
just had to know what mode you were operating in.
