No XML parser > should let you get away with that. He's using the so called "XML data islands" in his ***html*** page and it is just html -- not xml, therefore the above restriction does not apply. This is how MS recognizes an XML data island -- it's tagname must be "XML" (not sure about case sensitivity). Maybe when they start supporting XHTML, there'd be no longer xml data islands, or the name of that element will have to be changed.
