If you want all namespace declarations to appear at the top (although any namespace aware parser that requires that is definitely broken) then you need to arrange that your top level html element has all the necessary namespace nodes. Quite how to achieve that depends on information you haven't given, as to where these namespace names come from (ie are they known in advance, or just fixed set) for example <xsl:template match="pageTemplate"> <html xmlns="http://www.w3.org/1999/xhtml" xmlns:xscap="urn:xscap> .... would generate the output you indicated.
