No this happens at result tree building time not at serialisation. This doesn't make any difference in pure xslt 1.0 but in xslt x for x > 1 and with a node-set() extension function you get access to the result tree without it being serialised and it then matters that the result tree will be well formed without multiple attribute nodes with the same name sitting on a single element node.
