Well darn it, I wrote the function, but then it turns out that although I'm returning the xml of a dom document from my function that the xml gets escaped. This is irritating, I think I might have solved this once before but I can't remember how, the thing is it seems to follow how Microsoft describes extension functions in the documentation but that there was a workaround.
