I would guess that you define the param as follows <xsl:template match="zzzz"> <xsl:param name="cob_rowswet"/> which means the default value is an empty string rather than an empty node set and would generate the error that you state if ever the template is called without passing in the param. You need to make sure you always pass in the parameter, or make the default value a node set eg <xsl:template match="zzzz"> <xsl:param name="cob_rowswet" select="/.."/> causes the default to be the empty node set.
