I assume the asterisk is a typo. Try:

<xsl:copy-of select="selection[not(@lang) or not(@lang='german' or
@lang='french')]">

Always remember that a!=b in XSLT does not mean the same as not(a=b). If @a
doesn't exist, then @a=b and @a!=b are both false.
