Note that it _should_ be reported as an error, not silently accepted. xt does the wrong thing here as (in this part of the code) it is implementing the PR not the REC version of XSL. Making the xsl namespace declaration mandatory at the top level was a last minute change to xsl, specifically (I assume) to avoid this problem.
