What you have looks OK, and it seems to work in Saxon 6.5.2. Do you have the latest version of Saxon? Are you sure that it's these variables that are causing the problem? I suggest that if you are using the latest version of Saxon (6.5.2) you put together a small sample that includes full input and stylesheet and post it to the Saxon mailing list at saxon-help@xxxxxxxxxxxxxxxxxxxxx (see http://lists.sourceforge.net/lists/listinfo/saxon-help for how to subscribe).
