You can not use @$attributeName

Instead try: 
	<xsl:variable name="attributeName" select="'@charstyname'"/>
	 <xsl:variable name="before" select="preceding-sibling::*[1]"/>
  
  	<xsl:when test="not( $before[$attributeName='Footnote'] )">
    		[...]
  	</xsl:when>
