If your "html" is in fact well formed xml some some XSL systems (eg saxon) have extension elements to allow you to parse a string as xml. A better solution is to not have the CDATA marked section. CDATA means, in particular, that it is not _P_CDATA ie it should not be _Parsed_ for markup, it is strange (but strangely common) to explictly signal that some string should not be parsed, and then to require it to be parsed. If your xsl system hasn't got an extension element then you could see if it supports the data URI type document(concat('data:text/xml,',CONTENT)) would work in that case.
