That's not an "accessory line", it's called "XML declaration:
 http://www.w3.org/TR/REC-xml#sec-prolog-dtd

Use
 omit-xml-declaration = "yes"
in your xsl:output declaration. See
 http://www.w3.org/TR/xslt#output
