are sets 1 and 2 from different documents, if so one can never be a
subset of the other. In that case you must want to items to be "equal"
not of they are not the same node but rather if they have the same value.
union works on node identity not node value. I posted a value based
version earlier in the thread as did Michael (an that means I'm not
