Didn't Michael explain this one earlier? You need to use a node-set 
extension function unless you have the luxury of using XSLT 2.
For use in MSXML you will need to use ms:node-set($sorted) and declare

xmlns:ms="urn:schemas-microsoft-com:xslt"

in your stylesheet.
