This legacy > application is not open for editing. If you've got a bug in your system, then it's always best to fix the program that's wrong. If you can't fix it then it's best to ditch it and write a replacement. If you've got a boss who doesn't understand this, then it's best to get another job. If you can't get another job, write a filter application using Perl that converts the empty tag to a start tag / end tag pair, thus storing up even more bad legacy for your successors.
