It would except that would cause an error because the content of the
variable (element()+) doesn't match the required type
(document-node()) so you need to manually create the document node:

<xsl:variable name="foo" as="document-node()">
  <xsl:document>
    <a/>
    <b/>
  </xsl:document>
</xsl:variable>

....which is quite verbose in comparison to just leaving off the as
attribute.
