Colorado Governor Vetoes Piracy Legislation

" Colorado Gov. Bill Owens Thursday vetoed a state law backed by the
Motion Picture Association of America to broaden that state's
communication piracy laws, the Durango Herald reported. In his veto
message, Owens said that while the bill may be required, it wasn't
defined clearly enough, the paper says. "

NO INVESTIGATION NEEDED FOR DMCA GOOD FAITH TAKEDOWN NOTICE

" BA's Electronic Commerce & Law Report reports on Rossi v. PAA, a case
involving a DMCA notice and takedown request issued by the MPAA
regarding internetmovies.com, a site maintained by Rossi.  Rossi's site
was taken down, despite he absence of infringing material.  The court
dismissed Rossi's suit against the MPAA, ruling that a copyright older
does not need to conduct an investigation in order to qualify as a good
faith takedown request.  Rossi has appealed the decision to the 9th
Circuit Court of Appeals.
