It depends on whether or not the corporation is the "author" of the work.
If the copyrighted work was created by an employee of the company or through
a written work-for-hire agreement, then the corporation is the author and
the term is the shorter of 95 years from publication date or 120 years from
creation date.

If however, the work is created by an independent author or a freelancer
(neither are employees) who TRANSFERS the copyright to the company, then the
term is life of the artist plus 70 years, even though the company owns the
rights.

I cannot answer the second question because I am not familiar with the
thread of emails that lead up to it.
