Copyright Conversations

by Kimberly M. Bonner
I recently had a delightful conversation with
Professor Peter Jaszi, faculty director of
the Glushko-Samuelson Intellectual Property
Law Clinic and professor of law at the
Washington College of Law at American
University in Washington, DC. Professor Jaszi
began collaborating with the CIP as our IP
Scholar in January, 2009.

Although many are very familiar with Prof.
Jaszi's work, some in our audience are not.
In an attempt to introduce Prof. Jaszi to the
CIP audience, I interviewed him several weeks
ago.

Our conversation reflects Prof. Jaszi's
temperament, engaging, thoughtful, animated
and provocative. We discussed a variety of
topics including his legal background,
copyright history and current problems, best
practice in fair use development, concerns
for educators and his vision of a copyright
ideal. His answers sometimes surprise and
other times provoke. I encourage you to
listen to the interview and perhaps engage
him on the CIP's Collectanea Blog.

Enjoy!

THE BIG REVEAL

In the past few years, the Center for
Intellectual Property has been in the midst
of a relatively quiet, yet deliberate
transformation. And now I have the honor and
privilege of announcing "THE BIG REVEAL."

Always aware of the vast potential of digital
networks in general and social networks in
particular, the Center for Intellectual
Property is harnessing the power of these
networks through the CIP
Member
Community (http://rs6.net/tn.jsp?et=1102457164135&s=1764&e=001OpTLWJeP6e7DwYAaNI1KDdEqOFFmCxW9wQQWiKtlUS7CXacv0taZmdc3mND3Dqjhy-2jLqKEge9v8kLyWl4uT1iS9zISuMBM2YtVWBuFY6hntkIFbW1kYRb9q5DN6gdv1uuqCByL9-POmHXEHyMBlVSVOQT_c5GHxuZVxudKH10=).The CIP

a place online where users and creators of
works may find answers to their copyright
questions. The member community has three
foci— Clarification,
Connection and
Certification.

The CIP
Member Community clarifies (http://rs6.net/tn.jsp?et=1102457164135&s=1764&e=001OpTLWJeP6e4muuRdTaVYGEqtJbwNupEaAj0h5zl0V5k5ZHDq1gjfuOHOALWcJ7tdJcBpspSrfKmH4dausDUaBQ0lCsptkUlBF2vuSPrmtFnbiyo8LvB7ln7nldysMdOT5_T8kfGmXoaiaTK1BSqD0rnV0aROIApuzqIDs7V7yYiNkrGS8UinC5wMlIjo92RUtPz9GPrM1Tk=) areas of
copyright
confusion. Members may communicate via
a social networking community
built on the iModules platform. The platform
provides a forum where members interact with
colleagues and experts in the field, access
peer-submitted research and learning objects,
quarterly newsletters, and obtain legislative
alerts. CIP members will also have 20%
discounts on CIP educational programming.

The CIP
Member Community
connects (http://rs6.net/tn.jsp?et=1102457164135&s=1764&e=001OpTLWJeP6e4pMKflHf5xxLd6aX-FddzUP-q6kdo0LlDP1IL2b6WvPM6cWdJilGaTePFHx7G8HNc8-HLkQZNo7zZ0QiPM9AzADaagA02hmIC5eU4gVsaVsoHQe-aZjJDj2M9mVLz5CsTxW85yUUfo0DT6o3f46UvR7AoWtAN15YBZzHFhAsiepX7zGgJTFGWk) members professionally.
The platform allows
members to network professionally by posting
resumes, managing profiles, promoting
scholarship, participating in interest groups
and expanding professional contacts.

The CIP
Member Community
certifies (http://rs6.net/tn.jsp?et=1102457164135&s=1764&e=001OpTLWJeP6e4HKWikbFDmkkN0_tbBwK04o7PFVEtIv1uNzUEEJcADbTJnMLIiAduFypfVe1hxAtk2ml2QKQTOtLViyoJ8ZM0pZRHqL1WUjUitqSoq9W2Dcy7XO-4EoEB5RExianLOFROB4WFEWqeWTrDImi4ChKaywTzprBnasT-o23b11FTag_HN0AiHZfcfIuMCn8nZjWE=) members as copyright leaders in
higher
education. The certification enables
higher
education professionals to address a variety
of copyright related concerns such as
ownership of course materials, fair use,
e-reserves, licensing, open access
initiatives and development of copyright
awareness and education on campus. This
certification lasts for two years and is
renewable through active membership in the CIP
member community. In a world in which creative content
exponentially proliferates, we all have
copyright questions. We believe the CIP
Member Community provides answers.

Peter Jaszi Moderates ©ollectanea Blog

Reflections from Leading IP and Copyright Law Scholar

Alongside the CIP's collaboration with IP
scholar Professor Peter Jaszi about which the
CIP is excited (see: Copyright
Conversations), we are very pleased to
introduce him on the CIP's ©ollectanea
blog as the blog's new moderator.

Begun two years ago by the Center's then-IP
Scholar, Georgia Harper, ©ollectanea has
added its voice to the many copyright-related
blogs and has gained a growing readership. In his first few postings, Prof. Jaszi has:

* ...offered his perspective on the case of
graffiti artist Shepherd Fairey's wild
success with his now-iconic poster of
then-presidential candidate Barack Obama and
Fairey's subsequent legal entanglement with
the Associated Press and photographer Mannie
Garcia over whether or not Fairey's image
infringed on the copyright of the AP and the
photographer (Just when you thought you'd
heard enough about Shepherd Fairey and the
AP (http://rs6.net/tn.jsp?et=1102457164135&s=1764&e=001OpTLWJeP6e6Ed0B92I3MkEjxqDEZl5WZT6LIECF3-kwOEQ3xbnKMzZtr3vlDLLdJZ5NgUJqjqaW88ri3XC7wPThEsgR70-mFxotGhclAtIfI_mn16U7vomUkGUpf6e9JkPAhqDqVhP7X0DvS975lmwxNcn6rr8LQC36Rkzmuia2bpVFmZt_nSl16TCoCWKsx9O1yWq51fHRx5UCqnJgXMw==));

* ...commented on the spat between the
Authors' Guild (an advocacy organization of
professional writer) and Amazon.com regarding
the new text-to-speech function on Amazon's
Kindle 2 device (Copyright Bullies #1 (first
in an occasional series) (http://rs6.net/tn.jsp?et=1102457164135&s=1764&e=001OpTLWJeP6e4wF04QHhc_j2MzJEgHCLcuRrl9TdsCDEEwALjyzFQBn8-fRbemPBQHBaLZfK1OIEWTgDMGg2jDGdJFGcofayLlHNEvOW9FvsnK59xEABwdPts7rPTOzrkDgPsZmnlBNkpcUp3huuF5x-sNyNRI7oTurVWvfiSCfKJrZEhLckQV9JH4IUDBpO9_87nQCQdbp7blRbJWb0pHvg==));

* ...reflected on the educational fair use
provision as an exception in copyright law
that is critical to the mission of secondary
and higher educational institutions and some
of the challenges that educators face
surrounding fair use (Educational Fair Use: A
Provocation (http://rs6.net/tn.jsp?et=1102457164135&s=1764&e=001OpTLWJeP6e5evkU5a1oQrGRgVu24sisgAReMhySnv9w4B2p472aXvFTou5dYG_u1WuEN2rj-i7ClLagK2NmXnltIYTRmy3Mv6a3-H8bVhZlDAX2vwDjnQkB-UB3AajxEf09jnvWaRrLHnmTLyrRooUU4oofkIWE7T7C47BKsfP16JBsKJ5mW4Wum6HLLffspl9RJGwDoz17ZZUWJDDPP6g==)).
