why does the logic have to be _there_ which would require setting
something, and setting things isn't the XSLT way...
It appears that you want to take the second branch if either
$rainbow_color is orange, or if it isn't set, so just
<xsl:when test="not($rainbow_colour) or $rainbow_colour='orange'">
    <xsl:apply-templates........>
</xsl:when>
