[xsl] Count - Saxon & Xalan

Hi,
     The following works fine with Saxon, but fails with Xalan with the
error "Can not convert #RTREEFRAG to a NodeList!"

<xsl:variable name="NODES">
     <Nodes>
          <xsl:apply-templates select="Product" mode="Count"/>
     </Nodes>
</xsl:variable>
<!-- The part that fails -->
<xsl:variable name="COUNT">
     <xsl:value-of select="count($NODES//Nodes//Product)"/>
</xsl:variable>

<xsl:template match="Product" mode="Count">
     <!-- <xsl:if statements> -->
          <xsl:copy-of select="."/>
     </xsl:if>
</xsl:template>
