DTD constructs, such as DOCTYPE, are not XML elements. (DTD constructs are metadata, not data.) That's why you can't use <xsl:copy-of/> to copy the DOCTYPE. Similarly, <xsl:copy-of/> will not copy XML comments or processing instructions because they are not XML elements, and they are not part of the XML Infoset. Hope that helps.
