You can get avoid using the node-set() extension in cases like this by
using:
<xsl:for-each select="document('')/xsl:stylesheet/xsl:variable/dia">
...
</xsl:for-each>
An emtpy string for the document() function returns the stylesheet
itself, which you can then treat like a source document and access your
variable using Xpath. Slower, but portable.
