The style sheet will be used to generate a navigation menu in a .NET
component, so I can not set the top level to HTML.  The code needs
generate HTML on the fly and place it at a particular spot in an already
existing document. I can and did set the output:

<?xml version="1.0" encoding="UTF-8"?>
<xsl:stylesheet version="1.0"
	xmlns:xsl="http://www.w3.org/1999/XSL/Transform";>
<xsl:output method="html" version="4.0" indent="yes"/>

Everything seems to work fine now. I really appreciate all the feedback.

use <xsl:output method="html" and then msxml won't use /> syntax for
empty elements (which isn't valid HTML anyway).

(html output should be the default anyway if your top level element is
<html> in no-namespace, so you should not really need  <xsl:output
method="html" if you are generating html. What is your top level element
in the result?
