Martin correctly showed how you can match on the posted input, but if you have control over that input it appears that it is in error and should be fixed at source. (If the intention is the elemenet elem be in the same namespace as p.) The first form should probably look like <example xmlns="something"> <elem>value</elem> then it would be equivalent to the version using a prefix, and a simple Xpath would match both cases.
