I do *not* consider this an easy-to-solve problem. In fact, using TeX or LaTeX directly (without DSSSL/Jade), I often encountered similar strange problems trying to keep stuff together by penalties. Even LaTeX's "samepage" environment did not work most of the time. The only thing I found working right all of the time was LaTeX's internal \@startsection command, using it the way described in the LaTeX companion.
