The problem is that headers and footers only allow inline objects, but for a rule to coexist with other stuff, it needs to be displayed. You can sort of make it work by doing illegal things with paragraphs in the header or footer, but the results are unpredictable and not guaranteed to work and are not legal DSSSL.
