This can be done without the patent holder's knowledge or consent, but I don't know if it's without cost to amend a patent (I think it is without cost). In the short term, this has no effect, but in the longer term when someone does get around to challenging the patent, all the amendments would have the effect of putting the Patent holder in the position of having to prove the validity of the patent.
