You do it inside the variable declaration:

<xsl:variable name="querystring">
  <xsl:for-each select="param">
    <xsl:if test="position()!=1">&amp;</xsl:if>
    <xsl:value-of concat(name, '=', value)/>
  </xsl:for-each>
</xsl:variable>
