You don't say why you need a variable here.
<xsl:variable name="x" select="document ('file.xml')"/>
will do what you ask.

for example, although you could do this without using a variable, just
inline the function call.
<xsl:apply-templates select="document ('file.xml')/*"/>
Of course it doesn't have to be apply-templates you use, for-each of
copy-of or any other instruction can be used.
