Only because we are constructing an XML element. If there are no additional
limitations imposed, one can use the '&' character without escaping.

For example:





*$myConcat := function($s1, $s2){ $s1 || '&' || $s2}*

*return*
*   $myConcat('month', 'august')*

produces

   *month&august*

To summarize, any implementation of an element() function must throw an
error if passed unescaped ampersand(s), not just the XPath function
implementation.
