9th Circuit Rules on Priority of Security Interests in Unregistered
Copyrights

9/11. The U.S. Court of Appeals (9thCir) issued its opinion [PDF] in
Aerocon Engineering v. Silicon Valley Bank, a bankruptcy case involving
the question of whether federal or state law governs priority of
security interests in unregistered copyrights. The Appeals Court's
holding (that state law governs), as well as its discussion, may be of
interest to lenders who obtain security interests in software copyrights
as collateral for their loans."
