Subject: [digital-copyright] Instructors using content from previous publishers From: "Funke, Rebecca S." <rsfunke@xxxxxxxxx> Date: Mon, 8 Apr 2013 18:53:35 +0000 |
Good afternoon, Below is a request from a nursing faculty member. I've begun receiving this type of request more often and I'm curious if any of you are also receiving this type of question. How are you addressing it with your faculty? In a nutshell, she will be using a different textbook next semester and is wanting to use (next semester) PPT slides that she has access to (from the publisher) for the current textbook. The current textbook and the textbook used for the upcoming semester are from different publishers. In the past, I have had a discussion with the faculty person about any 'agreement' signed by the instructor, department, or college, upon the adoption of the selected textbook and accompanying instructor resources. I'm assuming there was some kind of licensing agreement in place for the electronic content, i.e. PPT slides, used by instructors, but I don't know if that is the case. I've cautioned the instructor to locate/read the agreement (assuming there was one) for information about using content. Here are my questions: * Do you know if electronic resources provided to instructor, with the adoption of a particular textbook, come with a licensing agreement? * Am I headed in the right direction here or is there a case for Fair Use? If a licensing agreement prohibits the use of the actually slides, is there room for her to use content, in her own words/slides? Here is her question: I have a question on a couple of courses that I am switching textbooks on for fall semester. New textbooks are from different publishers but there are a couple of competencies that aren't covered in the next textbook I'm using. So I'm wondering can I use power point slides from my old resource/textbook to include in the lecture for this course. If I can do this do I have to list on each individual slide where I got the information or can I do a slide at the end of the power points for slides 5-10 information from: and list the resource. Also sometimes I've made my own power point slides with information from the textbook, so can I use those and just cite the source at the end of the power points? Either way I'm talking maybe 10-20 slides of information for 2 different courses? I appreciate any thoughts. Rebecca Funke Director of Library Resources Des Moines Area Community College 2006 S.
