I would change your xsl:if to an xsl:choose, like this:

select="//DARBEDINGUNG[last()]/DARBEDINGUNG.laufzeitbis"/>
</xsl:when>
<xsl:otherwise>
<xsl:value-of
select="//DARBEDINGUNG[last()-1]/DARBEDINGUNG.laufzeitbis"/>
</xsl:otherwise>
</xsl:choose>
