Re: Librarian Authority in Webcasting Rule

Under Sec. 114(f) of the Copyright Act the Librarian is empowered to
convene a CARP (Copyright Arbitration Royalty Panel) to set rates for
use of sound recordings on the web. Under Sect. 802(f) the Librarian is
empowered to accept the CARP ruling or reject it in whole or in part and
promulgate a final rule. The decision can be appealed to the US Court
of Appeals for the District of Columbia.
