It seems to me that looking to the future this type of issue should be clearly dealt with in the institution's computer acceptable use policy, making clear to users that the institution's computer and email networks are primarily intended to be used for institutional-related purposes, that they are not completely secure (due to hackers, maintenance, etc), and that as a result, users have no reasonable expectation of privacy in sending emails over the institution's network.
