[On behalf of Robert H. Schrimsher] If the database is public domain, then no permission is required; however, if the database is not, regardless of the accessibility, permission should be sought from its owners. Normally if one seeks permission and explains why, it is usually granted. Robert H. Schrimsher, MLIS, Ed.D. We actually don't know where the database retrieved the image from. Maybe they are using it with someone's permission. Also, if it is a photo of a person, there are privacy issues at play. That would be my best guess!
