As an artist I feel that by publishing a work of art you have an obligation and responsibility to ensure that the public has access to that work. If you abandon this obligation and responsibility then the public has the moral right to take it upon themselves. Besides which, for the most part the authors of these 2600 games lost all control over their work when they sold the copyrights to corporations. You sell your copyright to someone else then you've lost all control over your work. It belongs to whoever owns the copyright. I'm a musician. With the exception of a trickle of funds from RBB (for the most part I took carts in lue of the $5) every sent I've made for the past few years has come from my work as a musician. I've made a large number of recordings over the years, work with bands of my own, soundtrack work, and session work for other musicians. When it comes to out of print works of my own, not only do I not mind them being distributed by other people, I openly encourage it. And the same thing goes for "bootleg" recordings of my live performances. There are some "bootleg" recordings flowing around southern ontario of a performance I did at "The Ragin' Cajun" and it thrills me to no end. Currently the entire OYCPI (old band of mine) is out of print. Even though I own the rights to this music I can't be bothered at this time to re-release it, so I'm thrilled that there are fans out there taking on this responsibility for me. And if they can make a buck or two at it, well more power to them. My primary motivation in my art is that of creation. Turning a buck from it is nice, but it's beside the point. Ultimately it's more important for me that my work finds its way into the hands of people who want it. Besides which... the "tape tax" will ensure that I receive royalties from all the bootleg copies out there on cassette.
