Libraries are authorized by the copyright law in Section 109 to lend software if the proper warning label is attached. The Copyright Office has the law at: http://www.copyright.gov/title17/92chap1.html#109 and the wording of the label is at: http://www.copyright.gov/title37/201/37cfr201-24.html. You might want to pick up The Copyright Primer for Librarians and Educators by Janis H. Bruwelheide as it has information about this in a more readable format than the actual law.
